Court sustains Gotani Hara’s Mzimba North East victory

The High Court in Mzuzu has dismissed an application by People’s Transformation Party (Petra) president Kamuzu Chibambo in which he challenged the election of Catherine Gotani Hara as Mzimba north east onstituency parliamentarian.

Chibambo, who finished fourth in the parliamentary race, asked the court to nullify the results on the basis that they were marred with irregularities.


High Court judge Thomas Ligowe said Chibambo through his lawyer Wesley Mwafulirwa failed to “sufficiently” prove the case and dismissed the petition.


Among others, Chibambo accused Gotani-Hara, who was elected Malawi's first female Speaker of Parliament last month,  of campaigning beyond regulation time and distributing money and other items as incentives to voters during the ‘prohibited’ period.


In his ruling, Ligowe said Chibambo had failed to bring sufficient evidence supporting the claim.


Chibambo also alleged that Malawi Electoral Commission failed to discharge its constitutional right when it failed to respond to his letter of May 24 2019, asking the commission to disqualify candidates embroiled in the alleged malpractices.


Ligowe ruled that none of the allegations “has been sufficiently proven.”


The court dismissed Chibambo petition with costs.
