The Constitutional Court hearing the presidential nullification case Thursday afternoon declined the application by Attorney General Kalekeni Kaphale seeking six days of adjournment of the explosive and high profile trial, but instead gave him two days over the weekend to undertake reading of new sworn statements.

 Malawi’s Attorney General Kalekeni Kaphale, who last week sought an interlocutory injunction restraining rights activists Gift Trapence, Timothy Mtambo and the Human Rights Defenders Coalition (HRDC), from calling for, convening or conducting any demonstrations in Malawi calling for the resignation of Justice Jane Mayemu Ansah, JA, SC, Chairperson of the Electoral Commission, has appealed against a high court ruling  that gave a go- ahead for the right activists to hold demos.

The explosive and high profile presidential nullification case kicked off Thursday at a makeshift constitutional court at BICC in Lilongwe, as the court was set to deliver a ruling on the application by the Attorney General Kalekeni Kaphale to adjourn the trial for six days to allow the defence read and understand fresh sworn statements served on them a day before commencement of the case, and also collect sworn statements from polling staff.
