Presidential election case resumes Friday after Supreme Court dismisses appeal

The Supreme Court of Appeal on Thursday quashed an appeal by Attorney General Kalekeni Kaphale acting on behalf of President Professor Arthur Peter Mutharika and the Malawi Electoral Commission (MEC) that sought to dismiss the presidential election case.

The appeal follows a ruling by the Constitutional Court that dismissed an earlier application by the AG on technical grounds.


Chief Justice Andrew Nyirenda who led a panel of seven judges said in his ruling that “having heard the skeleton arguments and having held counsel orally and having considered the matter in its entirety, wie dismiss the matter with costs.”


The Supreme Court ruling means the Constitutional Court will continue hearing the case on Friday under a panel of five high court judges headed by Justice Healey Potani.


Kapahale on Wednesday cocncluded cross-examining UTM President Saulos Chilima, the first petitioner who along with second petitioner Lazarus Chakwera of MCP are seeking to nullify the presidential result of the May 21 vote, claiming it was rigged in favour of the declared winner Mutharika.
