The case which came for the first time at the Lilongwe magistrate court on Monday morning has since been committed to the High court. The senior police officers include Assistant Commissioner of Police Evalista Chisale. They are implicated in the murder of Buleya whilst in custody at Lilongwe Police station in February 2019.

Resident magistrate Viva Nyimba has since committed the case to the High court for prosecution. Before the committal, Lawyers for the accused led by Enock Chibwana requested the court not to remand the suspects at Maula prison, but that they continue to be kept in cell at the Lilongwe Police station.

They argued some prisoners at Maula Prison might seek revenge against the accused, an argument Chief State advocate Jean Piriminta objected.

In his ruling Magistrate Nyimba threw out the application saying it lacked legal basis. He has since advised that the suspects liase with the State and Prison Officials on their safety.

Buleya Lule was arrested on suspicion of offering to "buy" a 14 year old boy with albinism from Mphanyama Village in Dedza for K800, 000. Lule died while in Custody. Various reports have suspected foul play on his passing on. Findings by a Malawi Human Rights Commission (MHRC) forensic autopsy report confirms that Lule died of electrocution.
