The former MASM Commercial Officer Andrew Ngomwa has been convicted of raping his 16 year old niece.


The Blantyre Chief Resident Magistrate Jean Kayira has also convicted Ngomwa of defiling his niece when she was 15.

The court also found Ngomwa guilty of gross indecent practice in the presence of a child.

Convicting Ngomwa, Kayira said having sexual intercourse in presence of a child is indecent.

However, the court acquitted Ngomwa on a charge of procuring sexual intercourse with a woman by administering drugs saying the state had failed to prove that Ngomwa gave alcohol to the victim inorder to rape her.

The state has since told the court that it will need 14 days to make submissions on sentencing, on the other hand, Ngomwa’s lawyer Fostino Maere, said the defence needed only a day to make oral submissions on the same.

The court has ordered the state to file it's submissions on 7th February and the defense will address the court on 10th.

The case has been adjourned to 17 February for sentence.

Meanwhile, the court has revoked bail for Ngomwa and he will wait for his sentence at Chichiri Prison.
